State laws require that agencies provide open access programs and services to the public, including those with Limited English Proficiency (LEP). To provide our customers with equal access to critical transportation-related information, the Maryland Department of Transportation State Highway Administration (SHA) has resources and implementation plans that provide services to our LEP customers.

SHA directs all offices that aid the public to take reasonable steps to provide those who have limited English proficiency with access to programs, activities, and services. The Employment and Program Equity Division within the Office of Equal Opportunity (OEO) provides SHA employees with technical assistance. This includes advising divisions of LEP requirements and implementation. OEO also helps develop plans for individual departments.

LEP Program Overview

People who do not speak English as their primary language and have a limited ability to read, speak, write, or understand English fit the federal definition of Limited English Proficient, or "LEP." These individuals may be entitled to language assistance for services, benefits, or meetings. Federal laws applicable to language access include Title VI of the Civil Rights Act of 1964, which prohibits discrimination based on national origin. Also applicable is Maryland Chapter 141 of the Acts of 2002.

Chapter 141 of the Acts of 2002

Chapter 141 of the Acts of 2002 requires Maryland State departments, agencies, and programs to provide equal access to public services for individuals with Limited English Proficiency (LEP). The law mandates that vital documents be translated into any language spoken by an LEP population that constitutes at least 3 percent of the overall population within a specified geographic area..
